General Terms and Conditions for the Online Sale of Vouchers

1. Scope of Application
These General Terms and Conditions (GTC) apply to the sale of vouchers in the Online Voucher Portal of WPHG Düsseldorf Operating GmbH, hereinafter Breidenbacher Hof at https://www.breidenbacherhof.com/en/vouchers

2. Contractual Partner
Only persons who have reached the age of 18 are permitted to purchase in our online voucher portal. The contract is concluded between you as buyer and WPHG Düsseldorf Operating GmbH - trading under “Breidenbacher Hof” - Königsallee 11, 40212 Düsseldorf, Germany, CEO & Managing Partner: Cyrus Heydarian, entered in Düsseldorf Local Court, Commercial Register B No. 57098 as seller.

3. Implementation of the Contract
The products (vouchers) presented in our online voucher portal are only to be understood as an invitation to order. They do not constitute a binding offer. Through ordering by clicking the button “Place Binding Order”, you make a binding offer to conclude a purchase contract regarding the chosen voucher(s). Confirmation that your order has been received is then immediately sent to the email address which you provided. The seller accepts your order by making the ordered voucher available to you – as the buyer – for downloading and printing (Print@home) in the online voucher portal and via email. If you choose the appropriate option in the online voucher portal, the ordered voucher can also be sent by post to the address you provided. In the latter case, the seller is not liable for any possible delays in delivering the voucher by post. During the ordering process, you can correct entry errors by clicking the “Back” button and subsequently making a renewed entry.

4. Right of Cancellation
You have the right to cancel this contract within fourteen days without stating any reasons. The cancellation period is fourteen days from the day when you or a third person named by you, who is not the carrier, has taken the goods in possession. To exercise your right of cancellation, you must notify us,

through an explicit declaration (for instance, a letter sent by post, telefax or email) stipulating your decision to cancel this contract. You may use the enclosed template cancellation form for this purpose, but this is not mandatory. To comply with the cancellation period, it is sufficient to send the notification of you exercising your right of cancellation before the cancellation period expires.

Consequences of Cancellation
If you cancel this contract, we must refund you for all payments which we have received from you, including the delivery costs (with the exception of any additional costs arising from you choosing another type of delivery other than the most cost-favourable standard delivery offered by us), and this payment must be made immediately and at the latest, within fourteen days after we receive notification about your cancellation of this contract. For this refund, we use the same means of payment that you used in the original transaction, unless otherwise explicitly agreed with you; under no circumstances will you incur any costs because of this refund.

5. Payment Modalities
You can pay the purchasing price for the voucher by credit card, advance payment or PayPal.

6. Redeeming the Voucher
You can exclusively redeem the voucher in our Hotel Breidenbacher Hof in Düsseldorf. A cash payment of the voucher is excluded.
If the price of the service for which the voucher is redeemed is less than the value of the voucher, the person redeeming it, receives a voucher in the hotel for the difference. The term of validity of the voucher for the difference is equivalent to the remaining residual term of validity of the original voucher, which has only been partly redeemed.
The right to redeem the voucher is time-barred within 3 years after the end of the year in which the voucher was issued (according to date of issue).

7. Dispute Resolution
The EU Commission has created an Internet platform for online dispute resolutions. The platform serves as a contact point for out-of-court settlement of disputes regarding contractual obligations arising from online purchase contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obligated to participate in a dispute resolution process before a consumer arbitration committee.
